Terms of Service

Last updated: July 2026 — This English version is intended for international users outside Germany. German users may be subject to the German AGB.

1. Who We Are and How These Terms Apply

These Terms of Service govern access to and use of Furnify3D, including the website at furnify3d.com, the web application, user accounts, trial access, subscription plans, upload, configuration, optimization, download and related support functions.

The Service is provided by Furnify3D GmbH, Elisabethstrasse 7, 99096 Erfurt, Germany, represented by its managing director Norbert Gräser. Commercial register and VAT details are published in the Legal Notice. Contact: info@furnify3d.com. Support: support@furnify3d.com.

These Terms are intended for the English-language version of the Service and for international users outside Germany. German users may be subject to the German terms and legal notices. Mandatory rights under the laws of a user’s country, state or province remain unaffected where they cannot legally be excluded.

By creating an account, starting a trial, subscribing, accessing downloads or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization.

2. The Furnify3D Service

Furnify3D is a web-based platform that allows users to search, view, configure and download 3D models and related product data from different manufacturers. Downloaded models are intended to be optimized for use with Enscape.

The Service may include search and display of manufacturer product data, model configuration where supported, downloads of Enscape-optimized model versions, cloud-based processing, user uploads, technical optimization of uploaded 3D models, account management, subscription management, billing and download history.

Enscape is not part of the Furnify3D Service. Users are responsible for obtaining and maintaining their own Enscape license and compatible software environment where required. System requirements may depend on the Enscape version, browser, internet connection, file format, device and hardware used by the user.

Furnify3D does not promise a specific commercial outcome, project suitability, permanent availability of any particular model, manufacturer dataset, catalog item, file format or third-party content, unless expressly agreed.

3. Business Users, Consumers and Eligibility

The Service is primarily designed for professional and business users, including architects, interior designers, planners, furniture manufacturers, dealers, visualization professionals and other commercial users.

Consumers may use the Service only where consumer subscriptions or consumer access are made available. If you are a consumer, nothing in these Terms limits mandatory consumer rights that cannot legally be excluded or restricted.

You must be legally capable of entering into a binding agreement and at least 16 years old. The Service is not directed to children and may not be used by persons below the age required by applicable law without valid consent from a parent or legal guardian.

4. Accounts, Security and Team Use

Certain functions require a user account. You must provide accurate and up-to-date information and keep your login credentials confidential.

You are responsible for activity under your account unless the activity was caused by Furnify3D’s breach of these Terms or by circumstances outside your reasonable control.

Where team accounts or multiple seats are available, the contracting party is responsible for managing authorized users and ensuring that all users comply with these Terms.

5. Trials, Subscriptions and Orders

Furnify3D may offer free or paid trials. Trial length, download limits, conversion rules and any payment requirements will be shown during signup or checkout.

If a trial converts into a paid subscription, this will only occur where the conversion, timing, price and required payment method have been clearly disclosed before the user commits to the trial or subscription.

Subscriptions may be offered as monthly, annual or other plans. The applicable features, usage limits, price, billing interval, currency, taxes and renewal terms are shown during checkout or in the account area.

By completing checkout, you submit an order for the selected plan. Furnify3D accepts the order by confirming the subscription, enabling account access, making the Service available or charging the payment method.

6. Payment, Taxes, Renewal, Cancellation and Refunds

Payments are processed through Stripe or another payment provider shown during checkout. Furnify3D does not store full payment card numbers.

If a subscription renews automatically, you authorize Furnify3D or its payment provider to charge the applicable recurring fees, taxes and charges to the payment method provided, unless you cancel before the applicable renewal deadline.

Unless a different cancellation deadline is shown during checkout, cancellation should be made at least 14 days before the end of the current billing period. Cancellation may be made through the account settings, a cancellation page if provided, or by contacting support@furnify3d.com. Consumers may have additional cancellation options required by local law.

Fees are generally non-refundable except where required by applicable law, where expressly stated during checkout or where Furnify3D grants a refund at its discretion. Statutory consumer rights remain unaffected.

Prices may be exclusive or inclusive of taxes depending on the customer type and market. Users are responsible for taxes, duties or charges that apply to their purchase unless Furnify3D is legally required to collect them.

7. Consumer Withdrawal and Cooling-Off Rights

Consumers in the EU/EEA, the United Kingdom and certain other jurisdictions may have a statutory cooling-off or withdrawal right when buying digital services or digital content online.

Where such rights apply, Furnify3D will provide the required information before checkout. For digital services or digital content supplied before the end of a cooling-off period, the law may require the consumer’s express consent to immediate performance and acknowledgment of the legal consequences for the withdrawal right.

If mandatory law gives you a stronger right to cancel, withdraw, receive a refund, repair, replacement, price reduction or other remedy, that mandatory law prevails over these Terms.

Details are set out in our separate withdrawal notice. A model withdrawal form for EU/UK-style consumer withdrawal rights is also included at the end of these Terms for convenience, where applicable.

8. Third-Party Content, Manufacturer Data, pCon.catalog and Enscape

The Service may make available 3D models, product data, catalog data, configuration data, images, trademarks, logos and other third-party content, including content from manufacturers or content made available via pCon.catalog.

All rights in third-party content remain with the respective rights holders. Furnify3D grants only those rights that are necessary for contractual use of the Service and that Furnify3D is permitted to grant.

You must comply with any additional license terms, manufacturer restrictions or catalog conditions that apply to particular models, products, data or content. This includes restrictions on modification, publication, redistribution, commercial use or transfer to third parties.

Furnify3D is independent from Enscape, pCon.catalog and the relevant manufacturers unless a partnership, certification or affiliation is expressly stated. Names, marks and product references are used only to describe compatibility, origin or functionality.

Content retrieved through the embedded pCon.catalog of EasternGraphics GmbH is additionally subject to the pCon.catalog Terms and Conditions of EasternGraphics GmbH. Usage rights in that content are granted by the respective manufacturer, who indemnifies users against third-party claims arising from rights in the data in accordance with those terms.

9. Furnify3D Platform Rights

Furnify3D and its licensors retain all rights in and to the Service, including software, user interfaces, workflows, database structures, designs, documentation, trademarks, trade names and other protected elements.

During an active subscription or authorized trial, Furnify3D grants you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Service for your internal business or personal project purposes, depending on the plan and customer type.

You may not copy, reverse engineer, decompile, disassemble, rent, lease, sublicense, resell, make available or otherwise exploit the Service except as expressly permitted by these Terms or mandatory law.

10. Downloaded Models, Outputs and Permitted Use

Downloaded models, optimized models, configurations, files and other outputs may be used only within the rights granted by Furnify3D and the applicable rights holders.

Unless additional license terms state otherwise, downloaded or optimized models may be used for your own visualization, planning, presentation and project purposes.

You may not resell models as standalone assets, publish them as a model library, mass-distribute them, provide them as a downloadable asset collection, use them to build a competing database or platform, or use them to train, test, validate or improve AI systems, machine-learning models or comparable automated systems.

If you use outputs in work for your own clients, you are responsible for ensuring that the use complies with applicable licenses, manufacturer restrictions and third-party rights.

For models and data originating from pCon.catalog, the following applies in addition: the usage rights granted by the respective manufacturer are personal, non-transferable and non-sublicensable. You may not incorporate the data into a collection or make it available for that purpose. Processing or modification — including the optimized versions generated by Furnify3D — is permitted only to the extent that the original character, specific features and identifiers of the data are preserved; you may not present the data as your own or disguise its origin. These restrictions also apply to files derived from the data. Furnify3D does not grant you any rights of its own in these models; it performs a technical processing service on the data you retrieve.

11. User Uploads and Customer Content

If upload functions are available, you may upload your own 3D models or other files for processing and optimization.

You represent that you have all rights required to upload, store, process, convert, optimize and download the uploaded files through Furnify3D and that the uploaded files do not violate law or third-party rights.

You grant Furnify3D a limited, worldwide, purpose-bound license to host, store, process, convert, optimize, temporarily cache and make available your uploaded files solely as necessary to provide the Service.

Furnify3D does not use customer uploads to train, test, validate or improve AI systems or machine-learning models and does not make customer uploads available to other customers unless separately agreed.

You are responsible for maintaining backup copies of your files. Furnify3D is not an archival storage service unless a specific archival service has been expressly agreed.

12. Acceptable Use and Prohibited Conduct

You must not use the Service in a way that is unlawful, infringes third-party rights, exceeds the authorized scope of use or threatens the security, integrity or availability of the Service.

Prohibited conduct includes scraping, crawling, automated extraction, systematic downloading, bypassing access controls or download limits, overloading the Service with bots or scripts, uploading malware or unlawful content, infringing intellectual property rights, sharing access without authorization, reverse engineering non-public interfaces, and using Service content, metadata, downloads or uploads for AI training or machine-learning datasets.

Furnify3D may suspend accounts, restrict downloads, remove content, refuse processing, terminate contracts or take other appropriate steps if it reasonably believes that these Terms have been violated or that use of the Service creates legal, security or operational risks.

Reports of allegedly unlawful content may be sent to info@furnify3d.com. Furnify3D will confirm receipt, review reports in a timely and diligent manner, take reasoned decisions on removal or blocking and inform affected users of significant decisions including the reasons (Art. 16, 17 of Regulation (EU) 2022/2065 for EU users). No automated decisions are taken without human review. Accounts used for repeated infringement of third-party rights may, after prior warning, be permanently suspended or terminated (repeat-infringer policy). Copyright owners may also use the notice-and-takedown procedure described in our Copyright / DMCA Policy.

13. Availability, Maintenance, Support and Changes to the Service

Furnify3D aims to provide a reliable Service but does not guarantee uninterrupted or error-free operation unless a separate service level agreement expressly applies.

Maintenance, updates, security measures, third-party outages, internet disruptions, force majeure events and other circumstances may temporarily limit access or functionality.

The embedded pCon.catalog is a service of EasternGraphics GmbH. Furnify3D has no control over its availability or content; the catalog may be changed, restricted or discontinued by its provider. No availability commitment is given for third-party services.

Support is available through support@furnify3d.com. Support scope, support hours and response times may depend on the applicable plan or separate agreement.

Furnify3D may improve, modify, add or discontinue features where this does not unreasonably impair the agreed core benefit of the Service or where changes are necessary for technical, legal, security, product or third-party-content reasons.

14. Privacy, Data Protection and Data Processing

Furnify3D processes personal data in accordance with its Privacy Policy. The Privacy Policy explains what data is processed, for what purposes, on what legal bases and with which service providers.

Where Furnify3D processes personal data on behalf of a business customer as a processor, the parties will enter into a Data Processing Agreement (DPA) under Art. 28 GDPR. The subprocessors engaged are published at furnify3d.com/en/subprocessors.

You are responsible for ensuring that personal data uploaded to or processed through the Service may lawfully be processed and that required notices, consents or other legal bases are in place.

15. Beta Features, Free Features and Test Access

Furnify3D may offer beta, preview, experimental, free or trial features. Such features may be incomplete, limited, changed or discontinued at any time.

Beta and free features are provided for evaluation and may be subject to additional limitations. They should not be used for critical production workflows unless Furnify3D expressly confirms otherwise.

16. Warranties and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. FURNIFY3D DOES NOT WARRANT THAT THE SERVICE OR ANY MODEL, OUTPUT, THIRD-PARTY CONTENT OR CATALOG DATA WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETE, CURRENT, COMPATIBLE WITH EVERY SOFTWARE VERSION OR SUITABLE FOR EVERY PROJECT.

Nothing in these Terms excludes warranties, guarantees or remedies that cannot be excluded under mandatory law, including consumer guarantees that may apply in jurisdictions such as Australia, New Zealand, Canada, the United Kingdom, the EU/EEA or individual U.S. states.

You are responsible for checking whether downloaded or optimized models are suitable for your project, software version, rendering environment, legal use case and applicable third-party license conditions.

17. Limitation of Liability

Nothing in these Terms limits or excludes liability for intent, gross negligence, fraud, fraudulent misrepresentation, death or personal injury caused by negligence, product liability or any liability that cannot legally be limited or excluded.

For business users, Furnify3D’s liability for slight negligence is limited to breaches of material contractual obligations and to foreseeable, typical damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FURNIFY3D SHALL NOT BE LIABLE TO BUSINESS USERS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS, LOST SAVINGS, LOSS OF DATA, BUSINESS INTERRUPTION OR THIRD-PARTY CLAIMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

For business users, Furnify3D’s aggregate liability per calendar year is limited to the fees paid by the user to Furnify3D in the twelve months before the event giving rise to the claim, to the extent permitted by law.

For consumers, the limitations in this section apply only to the extent permitted by mandatory consumer protection law. Some jurisdictions do not allow certain exclusions or limitations, and in those jurisdictions the limitations apply only to the maximum extent permitted.

18. Indemnity by Business Users

Business users will indemnify and hold Furnify3D harmless from third-party claims, damages, costs and reasonable legal expenses arising from user uploads, infringement of third-party rights, violation of model or catalog license terms, unlawful use of the Service or breach of these Terms by the business user or its authorized users.

Furnify3D will notify the business user of relevant claims and, where reasonably possible, allow the business user to participate in the defense or settlement.

19. Export Control, Sanctions and International Use

You must not use, export, re-export, provide access to or transfer the Service, downloads or outputs in violation of applicable export control, sanctions or embargo laws.

You represent that you are not located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive sanctions and that you are not listed on applicable sanctions lists.

You are responsible for complying with local laws, industry rules and third-party rights that apply to your use of downloaded models and project outputs.

20. International Consumer Terms and Mandatory Local Rights

These Terms are intended to operate internationally. They are not intended to deprive consumers of mandatory rights in their country, state or province of residence.

EU/EEA and UK consumers may have pre-contract information rights, withdrawal or cancellation rights and statutory remedies for digital content or digital services. Canadian, Australian and New Zealand consumers may have non-excludable consumer guarantees and remedies. U.S. consumers may have rights under federal or state law that cannot be waived by contract.

If a mandatory local law conflicts with these Terms, the mandatory local law will apply to the minimum extent required, and the remaining Terms will continue to apply.

21. Suspension and Termination

Furnify3D may suspend or terminate access if you materially breach these Terms, fail to pay fees, create security risks, violate third-party rights, engage in scraping or AI training, misuse downloads, circumvent restrictions or use the Service unlawfully.

After termination or expiry, access to paid functions may end. You should export needed files before termination where export functionality is available. Statutory retention obligations and legitimate backup or security retention may continue to apply.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

For business users, the exclusive place of jurisdiction is Erfurt, Germany, where legally permissible.

For consumers, this choice of law and jurisdiction applies only to the extent it does not deprive the consumer of mandatory protections or mandatory courts available under the laws of the consumer’s habitual residence.

Furnify3D is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German Consumer Dispute Resolution Act (VSBG), unless mandatorily required by law.

23. Changes to These Terms

Furnify3D may update these Terms where required for legal, technical, security, commercial or product-related reasons.

Material changes will be communicated by email, in-app notice or another appropriate method. For business users, continued use after the effective date may constitute acceptance where legally permissible and where the user was informed of this effect. For consumers, changes apply only in accordance with mandatory consumer law.

24. Miscellaneous

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be replaced by the applicable statutory rule or by a valid provision that most closely reflects the economic purpose, where legally permissible.

You may not assign or transfer your rights under these Terms without Furnify3D’s prior consent, except where mandatory law allows otherwise. Furnify3D may assign or transfer these Terms in connection with a merger, restructuring, sale of business or similar transaction, provided mandatory user rights remain unaffected.

Electronic communications. By using the Service you consent to receiving contracts, notices, disclosures, confirmations, invoices and other communications from us electronically, in particular by email to the address associated with your account or within the Service. You can withdraw this consent by closing your account; statutory rights to receive certain information in another form remain unaffected.

These Terms, together with the order details, Privacy Policy, Data Processing Agreement where applicable and any plan-specific terms, form the agreement between you and Furnify3D for the Service.
